§ 1. Introduction

These terms and conditions for using the services of the Electroepilation Cabinet (hereinafter referred to as the "terms and Conditions of the Cabinet") determine the rules for the use by a person who has purchased or plans to purchase an electroepilation service provided in Electroepilation cabinets or a person for whose benefit the service has been purchased by a third party (hereinafter referred to as the "customer") of services offered by specialized Electroepilation cabinets operated by the company ELEKTROEPILACJA.PL spółka Z ograniczoną odpowiedzialnością with its Registered office in Warsaw, at UL. Grzybowska 87, 00-844 Warsaw, entered into the Register of entrepreneurs of the National Court register maintained by the District Court for m.st in Warsaw, XIII Commercial Division of the National Court register under KRS number 0001064299, REGON 526700960, NIP 5273080710( hereinafter referred to as the" company"), the company's electronic address for correspondence is contact@elektroepilacja.pl, Tel. 515222832.

All terms written in the terms and conditions of the Cabinet with a capital letter have the meaning given to them in the terms and Conditions of the website, unless otherwise follows directly from these Terms and Conditions of the Cabinet.

The company or Partner offers the provision of services or the sale of products in the offices of Electroepilation in the locations indicated on the website on the basis of a contract for the provision of services or the contract for the sale of products concluded by the service or the contract for the provision of services in the offices of Electroepilation ("contract for the provision of services in the offices of Electroepilation") or the contract for the sale of products concluded in the offices of Electroepilation ("contract for the sale of products in the offices of Electroepilation").

Opening hours are set individually for individual Electroepilation rooms. Information about the opening hours of a particular office can be obtained at the service, the company's headquarters, in each of the Electroepilation offices or by contacting the contact details of the Office visible on the service.

The office offers the provision of comprehensive electroepilation procedures on the body or its parts and the provision of advice and consultation in the field of electroepilation and other services not directly related to medical procedures (hereinafter collectively referred to as "services") and the sale of products related to electroepilation.

The main treatment provided in the offices is electroepilation, which consists in permanent hair removal in the place indicated by the client, by inserting a thin probe into the hair shaft and applying a current that destroys the hair bulb ("Electroepilation procedure"). The office may also offer other services of an aesthetic nature, e.g. consultations on electroepilation and others (hereinafter collectively referred to as the"treatment").

The office may also offer a set of a certain number of treatments for selected body parts offered by the company or partner in the offices, which can be used within 12 (twelve) months from the date of the first procedure, the purchase or reservation of which is possible in the Electroepilation offices (the"package").

The office can also offer a package of a certain number of hours of electroepilation treatments, which the client can use for treatments on selected body parts. This package, composed individually by the buyer, is available for use within a specified period, starting from the moment of the first procedure. Purchase or reservation of a package of hours is possible in any of our Electroepilation offices.

Persons of legal age with full legal capacity, as well as persons with limited legal capacity, are entitled to use the procedures, but only after obtaining the written consent of their legal guardian, submitted in person before the start of the procedure in our Electroepilation Office.
§ 2. The contract for the provision of services in the office and the contract for the sale of products in the Office

By purchasing a service or product in the Office, the customer confirms that he has read the terms and conditions of the office and accepts them. Purchasing a service or product also means making a statement about the absence of Health contraindications to the use of the services and accepting the statements contained in the customer card.

The contract for the sale of products in the Cabinet applies to products available in the Cabinet's offer. The purchase of a product involves the need for payment by the customer, and the contract for the sale of products is concluded at the time of receipt of payment by the Cabinet.

Similarly, the purchase of services provided in the Office obliges the customer to pay, and the contract for the provision of services in the Office is concluded upon receipt of payment. After the conclusion of the contract for the provision of services, the customer will receive a confirmation of the reservation of the service to the provided e-mail address or phone number.

Payments for services and products offered in the office can be made on site in cash or by credit/debit card.

From the contract for the provision of services in the office and the contract for the sale of products in the office, you do not have the right to withdraw from the contract.

The client should start the implementation of the service within 6 months from the date of its purchase and during this period use the services of the Cabinet, performing the procedure. Failure to perform the service by the customer within the specified period results in the loss of all rights to the service, including the right to a refund or compensation for unrealized Service.
§ 3. Customer's Obligations

Customers of the Cabinet are obliged to read the terms and conditions of the Cabinet and the terms of Service Elektroepilacja.pl available on the website before the procedure and to comply with its provisions and follow the recommendations of the Cabinet staff. Each client who uses the offer of the office, especially those who proceed to the procedure, declares that he has read the terms and Conditions of the office, that he fully accepts its terms and does not raise any objections to it.

In addition, the client is obliged to fill out and sign the client card before proceeding to the procedure. The client card is a document in which the client indicates his / her medical history to exclude existing contraindications to the procedure, reads and declares that he / she has familiarized himself / herself with the procedure, is aware of the benefits and possible side effects, and agrees to voluntarily perform the procedure. The customer card template is available on the website and in the Office.

In addition, the customer has the opportunity to fill in the customer card (consent form and verification of contraindications) online in electronic form immediately after booking the appointment for the procedure.

The Office employee or the hotline employee conducts an interview with the client in order to determine whether, due to the client's health condition, past illnesses and lifestyle, there are no contraindications to the procedure and in order to determine post-treatment recommendations. The client is obliged to inform the Office employee about any contraindications and other circumstances relevant to the procedure, such as diseases, inflammations, pregnancy, medications taken, etc.

The purchase of the treatment service in the Office is tantamount to the submission by the client of a statement that there are no health contraindications to the use of the service and with the acceptance of the terms and Conditions of the Office.

In case of any other doubts, we recommend that you consult your doctor. We ensure that the safety and well-being of our customers is our priority.

Detailed contraindications to the implementation of individual treatments are specified in the client's card, which is signed before the start of the procedure or filled in online in electronic form. The model of this card is also available on our website.

The client is obliged to inform our specialists about the possible deterioration of well-being during the procedure.

The client is obliged to follow the recommendations that will be given to you after the procedure.

In case of any doubts about the safety of the procedure, our staff can refuse to perform it or offer another date. If you have already made a payment and the procedure is not carried out due to the circumstances, we provide a refund.
Contraindications to the use of treatments in our electroepilation office are:
1. immunodeficiencies (HIV, hepatitis or other immunodeficiencies)
2. asthenia (generalised weakness)
3. neuropsychiatric disorders
4. Pregnancy (first trimester), lactation (first 6 months)
5. Epilepsy
6. Oncological diseases
7. Heart disease, including hypertension and ischaemic disease and heart defects
8. Taking photosensitizing drugs
9. Varicose veins at the site of exposure
10. Taking Roaccutane (Isotretinoin) for 6 months before surgery
11. Taking antibiotics for 2 weeks before depilation
12. Diabetes in the stage of decompensation
13. Somatic diseases in the acute phase.
14. Hyperthermia
15. Haemophilia, blood clotting disorders and use of medicines that reduce blood clotting (anticoagulants)
16. Metal implants, including "gold threads" in the treatment area
The procedure can be dangerous for people with metal implants, including "gold threads" in the treatment area.
17. Presence of a pacemaker or cochlear implant
18. The presence of infectious and inflammatory processes on the skin, including exacerbation of chronic skin diseases and any other disorders of the integrity of the skin (warts, herpes, fungal diseases, cuts, birthmarks, fresh scars, sunburn, lichen, inflammation, acne, etc.)
19. Menstruation
It is not recommended to perform the procedure during menstruation due to the increased sensitivity of the skin and the possible risk of infection.

§ 4. Cabinet Offer

The prices of services or products (with the exception of treatment prices) indicated on the Website do not constitute a commercial offer within the meaning of the provisions of the Civil Code. The only source of valid prices (excluding prices of treatments) is the price list available in each office. The office reserves the right to change the price of the service or product indicated in the price list in the case of an individually granted discount.

The amount of payments for the offered treatments and treatment packages purchased in the Office is determined by the price list of treatments and packages. The prices given in the price list of treatments and packages are gross prices. The price list of treatments and packages is also available on the website.

The prices of services indicated in the price list of treatments and packages and the price list of packages (hereinafter collectively referred to as the" price list") do not apply in the case of a customer's request to perform a custom treatment that goes beyond the scope of services covered by the price list. In each of the above cases (discount from paragraph 1 or custom treatment), the customer will be notified of the total final gross price of such treatment or service before the performance of the service and will be able to withdraw from the use of the treatment or service at his own choice. In the event that the client has paid for the treatment at the time of booking, and the price of the treatment will change as a result of the application of a discount or the treatment is considered to be non-standard after payment, respectively, the Office will refund the payment in the amount representing the difference between the price paid for the treatment and the price of the treatment after taking into account the discount, or the client will be obliged to pay the difference between the price paid for the treatment and the actual price of the non-standard treatment. If the client makes a payment for a procedure that turned out to be non-standard (as a result of which its price increased) and withdraws from using the procedure for this reason, the Cabinet will refund the payment made by him to the client.

Promotions and discounts provided by the company or partner are not subject to combination – this also applies to promotions and discounts offered through the websites indicated in paragraphs 9,10 and 11 of this paragraph.

Treatments and services sold in the package cannot be discounted. The conditions for receiving the discount will be indicated by the employees of the Cabinet, set out in separate regulations or will be given in each of the offices in an appropriate way.

The purchased single treatment is valid for 2 (two) months counted from the date of its purchase – during this period you must use the services based on the purchased treatment. After the expiry date, the treatment shall cease to be valid and the holder of the treatment shall lose the rights arising therefrom. In the event that the treatment is not carried out by its holder or wants to use it after the validity of the treatment, its holder does not have any rights in possession of the purchased treatment, nor can he claim compensation or refund of the fee for the treatment.

The total number of Electroepilation procedures performed as part of one package is a maximum of 10 Electroepilation procedures (hereinafter referred to as the "Electroepilation package"). As part of the purchase of the Electroepilation package, the client acquires the right to use the services of the Cabinet in the form of Electroepilation procedures for a period of 12 (twelve) months from the date of purchase of the Electroepilation package. After this period, the package loses its validity and the customer loses the resulting rights. If the customer fails to implement the package or wants to use it after the expiration date of the package, the customer does not have any rights in possession of the purchased package, nor can he claim compensation or refund of the package fee. If the client purchased an Electroepilation package, and in the course of its implementation it turned out that fewer treatments are needed than the maximum number of treatments provided for in the package, the client is not entitled to refund the difference for unused treatments. In the event that the client has purchased an Electroepilation package, and in the course of its implementation it turned out that a greater number of treatments is needed than the maximum number of treatments provided for in the package, the client has the opportunity to purchase additional treatments at the price specified in the price list.

The company may also occasionally offer the opportunity to purchase an electroepilation treatment at a promotional price through the Groupon website, available at groupon.pl. each coupon purchased through this service is nominal. The customer has the right to use the promotion offered through Groupon only once. The customer, in order to use the purchased coupon, is obliged to confirm his / her identity to the Cabinet employee by presenting an identity document. The coupon may include the service of one electroepilation procedure or a package of electroepilation procedures. Making a payment for a coupon through the Groupon service and under the conditions specified therein is tantamount to making a payment for an electroepilation procedure.

The company may offer customers the opportunity to obtain a discount on electroepilation treatments on the terms specified in separate terms and conditions or the terms described on the website.

The company can also offer a bonus for a new client who buys his first electroepilation treatment, a package of electroepilation treatments. If the client uses the agreed electroepilation procedure, he will be entitled to a discount on this procedure in the amount of PLN 50.00 (fifty zlotys). If the customer has purchased an electroepilation treatment, the package of electroepilation treatments before receiving the above discount, he can use it for a Voucher. The customer has the right to use the discount indicated in this paragraph only once.

Services and products purchased in the Office are non-refundable.

Taking into account the fact that the operation of the Electroepilation procedure depends on the individual predisposition of each client and depends m.in. since the construction of the hair and the phase of the hair growth cycle, neither the company nor the Partner within the package of Electroepilation treatments does not guarantee the full effect of depilation.
§ 5. Liability

Failure of the client to comply with the requirements of these regulations of the office, including in particular failure to inform about health contraindications to the use of the services of the office, results in exclusion of the responsibility of the Office, the partner and the company for possible health complications of the client after the procedure. The client is solely responsible for any consequences associated with concealment or omission of any disease or disease indicated in these Cabinet rules or client card as a contraindication to the performance of treatments.

The clinic, the Partner and the company are not responsible for the lack of the desired results of the treatment or complications after the treatment in case of non-compliance with the recommendations of the after-treatment and home care.

The information provided in the office and provided by the staff of the Office are informative and educational and cannot replace the advice and recommendations of the doctor. By using the offer of the Office, the client is aware, confirms and agrees that the Office does not offer consultations and medical advice.

The contractor guarantees the permanent removal of specific hairs that have undergone the procedure, provided the complete destruction of their hair follicle. However, the contractor reserves no responsibility for the possible appearance of new hairs in the processed area in the future, as this may be due to natural physiological processes of the customer's body, over which the contractor has no influence.The use of Electroepilation procedures is not tantamount to a guarantee of complete or eternal depilation. The use of treatments, other services or products does not guarantee a complete or lasting effect.
§ 6. Complaints

The customer has the right to make a complaint about the service.

The complaint must be made in writing and sent by registered letter to the address of the Registered Office of the company specified in § 1 Paragraph 1 of these regulations.

The complaint should contain at least: the name, surname, address, e-mail address (e-mail) of the client, the office where the Electroepilation service was provided, the subject of the complaint with an indication of the client's request and any circumstances justifying the complaint. 4. If the data or information provided in the complaint needs to be supplemented for its proper consideration, before considering the complaint, the company will ask the customer via the provided address or e-mail address to complete it within the specified scope and time limit.

The company assesses the subject of the complaint and its validity within 14 (fourteen) days from the date of its submission. The company will inform the customer about the refusal to take into account the complaint and its reasons in writing or by sending a message to the customer's e - mail address-depending on the form of filing the complaint. If the company does not respond to the complaint within 14 (fourteen) days from the date of its receipt, the complaint shall be deemed justified. 6. In the event of a dispute between the company and the client regarding the validity of the refusal to take into account the complaint, the client has the right to use out-of-court methods of considering the complaint and pursuing claims. The client may use mediation or amicable jurisdiction by providing the institution before which the proceedings will be conducted with an appropriate form – an application for mediation or an application for consideration of the case before an amicable court. A list of sample institutions, together with their address data, is available at uokik.gov.pl.
§ 7. Reservation

The cabinet allows m.in. making advance reservations of services, through the service, through the website or mobile application.

Booked services must be reported at the appointed time (5 minutes before the planned procedure). In the event of a significant delay (more than 10 minutes) for the booked service by the customer, it may be necessary to shorten the service or set a new date for its performance. In this case, the Cabinet may refuse to perform the service through the fault of the customer and indicate a new date in which the service will be performed.

The client should inform the office (by phone, e-mail or in person) about the need to change the date or cancel the scheduled visit or service at least 48 (forty-eight) hours before the scheduled visit. In the absence of cancellation of the booked visit before the expiration of 48 (forty-eight) hours before the date of performance of the service, this service is considered to have been performed, and the amount corresponding to the price of the service set in the price list or individually with the customer is not refundable. In the event that the client fails to show up for the appointment three times, when arranging the next visit, the Cabinet staff has the right to ask for a prepayment, which is lost when he does not show up at the appointed time. Prepayments can be made by cash, card or bank transfer. In this case, the amount must be credited to the account no later than 1 (one) day before the service date.

The Cabinet has in its offer vouchers (Bon). In the absence of cancellation of the booked term of the service or a visit under the voucher (Bon) before the expiration of 48 (forty-eight) hours before the date of performance of the service, this service shall be deemed to have been performed, and the amount corresponding to the price of the service set out in the price list or individually with the customer shall be deducted from the voucher (Bon). In justified cases and exceptional random situations, it is allowed to extend the term of voucher (Bon) or exchange services after individual consultation with the Cabinet staff.

The office reserves the right to cancel the service with a simultaneous change of the booking date or the possibility of arranging a new date at a later time. In emergency situations, customers will be informed of the need to cancel the service or change the service date as soon as possible, in other cases – before 24 (twenty-four) hours before the appointed date. If it is necessary to change the term of the service, resulting from the circumstances on the side of the Office, the client chooses the most convenient for himself the nearest free term for the performance of the service. If the change of the term concerns the service within the voucher (Bon), The Voucher shall be extended by a period equal to the present delay. In the event that the customer who has paid for the service does not meet any of the new deadlines for the performance of the service, the Cabinet will refund to the customer the payment made by him for the price of the service.
§ 8. Final provisions

Meals are not allowed in the treatment room. There is a total ban on smoking and drinking alcoholic beverages throughout the Office.

The Cabinet is not responsible for children left unattended in the Cabinet. The parents or their legal guardians are responsible for any damage or destruction caused by children.

The client is financially responsible for the culpable damage or destruction of the office equipment.

The Cabinet is not responsible for valuables left unattended outside the designated storage area.

In matters not regulated in these Cabinet regulations, the provisions of the Civil Code shall apply.

The Cabinet reserves the right to amend these Cabinet regulations.

The cabinet will inform the Cabinet about the change of the regulations by making the content of the new regulations available on the website and in the offices within 14 days before the entry into force of the new regulations.

Cabinet regulations are available in the service and offices.
-
The law applicable to these Cabinet regulations is Polish law.

If any provision of the regulations is found to be invalid or ineffective, this will not affect the validity or effectiveness of the remaining provisions of the regulations.

These Cabinet regulations come into force on 23.02.2024
